1. The Site Administration undertakes to provide the Copyright Holder with cover design services for the Copyright Holder's book (hereinafter referred to as the "book"), and the Copyright Holder undertakes to accept and pay for the services provided in accordance with the conditions specified in these terms.
2. The Site Administration has the right to provide services for book cover design both personally and with the involvement of third parties, while the Site Administration is responsible for actions performed by third parties, as for its own.
3. Cover design involves the designer's work on existing images. The cover design does not include the creation of original works of art. Cover design involves creating design layouts for both the electronic and printed versions of the book.
4. The cover design is created based on the data specified by the Copyright Holder in the Terms of Reference, which is filled out by them using the technical functionality of the Site, as well as, if necessary, with the help of technical support staff.
5. In the event that the Copyright Holder's Terms of Reference for the cover design provide for illustrator services, i.e. services for creating original artistic works – images, the Site Administration contacts the Copyright Holder using the technical capabilities of the site, and offers the Copyright Holder the services of an illustrator for creating an illustration for the cover and cover design:
5.1. with an illustration of medium difficulty. An illustration of medium complexity is defined as black-and-white graphics, local fills, and medium detail. (Technique: pencil, ink, vector graphics, collage / editing, graphics, 2D, pixel art, photography);
5.2. with a highly complex illustration. A high-complexity illustration refers to a high degree of detail (depth and planning) of the image. Complex engravings, watercolor paintings. Manual or computer graphics, infographics. (Technique: 3d, watercolor, ink, acrylic, gouache, painting, mixed media, CG illustrations).
6. The copyright Holder has the right to accept the offer of the Site Administration and order cover design services with the creation of an original artistic work (illustration). In this case, the Copyright Holder pays the cost of illustrator and cover design services agreed by the parties. However, unless otherwise agreed by the parties, the price of an order for an illustrated cover includes the production of an illustration only for the front cover. If it is necessary to prepare an illustration for the back cover, the Copyright Holder informs the Site Administration about this, and the service of creating an illustration for the back cover is paid for by the Copyright Holder separately. The cost of illustrator and cover design services when ordering them is jointly reported by the Site Administration on the service delivery page and is valid at the time of placing the order.
7. A cover design is a combination of cover components, i.e. image, text font, background color, and font color.
8. If the text of the book contains profanity, the cover created by the Site Administration for the printed copy of the book will contain a graphic warning "contains obscene language" in accordance with the requirements of the applicable legislation.
9. After creating the cover design, the Copyright Holder is given a choice of two cover design options. The copyright holder has the right to request changes to one of the submitted versions no more than twice at no additional cost. Based on requests for edits from the Copyright Holder, the site Administration will create a third version of the cover. If the first two versions of the cover design submitted to the Copyright Holder are not satisfied, the Copyright Holder has the right to request the third version of the cover design immediately. In this case, edits can be made no more than once.
10. Under the cover design option, the Parties understand the sequence of arrangement of cover elements in the cover design project, for example, the location and size of the image, the presence of a background, the location of the book title and the author's name.
11. Images are selected by the designer from open sources (photo banks) of images, or the right to use the image is acquired by the Site Administration on specialized sites on its own behalf, but at the expense of the Copyright Holder.
12. If the image for the book cover design is provided by the Copyright Holder, the Copyright Holder guarantees that the use of this image does not violate the rights of third parties, and also guarantees that any claims regarding the legality of the use of the image received by the Site Administration from third parties will be resolved by the Copyright Holder independently, on its own behalf and at its own expense.
13. The Copyright Holder grants the Site Administration permission to publish the result of the services rendered and information about the services rendered on its website, in its portfolio, informational materials, newsletters, and on the Site Administration's pages in social networks.
14. The cost of services provided by the Site Administration for creating a book cover design is indicated by the Site Administration on the service delivery page and is valid at the time of placing the order. The copyright holder is obliged to transfer 100% of the cost of services in the form of prepayment to the bank account details of the Site Administration.
15. The Site administration starts providing services only after 100% of the cost of the services provided is credited to the bank account. The date of crediting funds to the current account of the Site Administration is recognized as an expression of the Copyright Holder's will to provide the service in accordance with these rules.
16. If the Copyright Holder refuses the cover design services, the funds actually paid by the Copyright Holder for the cover design service are returned to the Copyright Holder after deducting the intermediary bank's commission for providing bank transfer services, or may be credited by the Site Administration to other services provided by the Site Administration at the time of refusal of the service, or services that will provided in the future, at the choice of the Copyright Holder. If the Site Administration has already started providing services, a unilateral refusal of the Copyright Holder from the services is not allowed.
17. The term of rendering services will be agreed by the parties separately, depending on the actual workload of specialists, but in any case it can not exceed one calendar month from the moment the Site Administration receives funds in the amount of the full cost of the ordered services.
18. The Site Administration has the right to refuse to provide services at any time, provided that the Copyright Holder returns 100% of the prepayment received from him for the provision of services, minus the commission of the intermediary bank for the provision of banking services for money transfer, if there is a technical impossibility to fulfill the obligations assumed.
19. If the Copyright Holder does not approve any of the proposed cover design options, the Site Administration's obligations to create the cover design are considered fulfilled, and no refund is made for the services performed.
